These Terms govern your use of the bot-marketplace.com website and of the software and services provided by Bot Marketplace ("we", "us"). By creating an account, purchasing, downloading or using any of our products, you agree to these Terms. If you do not agree, do not use the Services.

2. What we provide - and what we do not
We provide informational software tools:
- Signal Bots - desktop applications (Windows, macOS) that monitor market data and notify you when a technical condition you configured is met.
- Whale Radar - a desktop application that notifies you of large on-chain transfers.
- AI Analyst - a web tool that produces market analysis in response to your questions.
- Portfolio Tracker - a web tool that reads a screenshot of your holdings and revalues them at current market prices.
We expressly do not provide:
- automated order execution, automated trading or "autopilot" functionality;
- brokerage, dealing, custody, or any regulated investment service;
- investment advice, personal recommendations, or portfolio management;
- any guarantee of profit, accuracy, or trading outcome.
Our software does not connect to your exchange accounts, does not require exchange API keys, does not hold or move your funds, and cannot place orders. Every trading decision and every order is made and executed by you.
3. Not financial advice
The content, signals, scores, labels (including any "STRONG / MODERATE / WEAK" strength rating) and analyses produced by our Services are informational and educational only. They are generated automatically from public market data and technical indicators, and do not take into account your personal financial situation, objectives, or risk tolerance.
Any stop loss or take profit level shown alongside an alert is a suggestion consistent with the strategy being monitored, not a prediction or a recommendation.
Nothing in the Services constitutes financial, investment, legal or tax advice. You should seek independent professional advice before making any investment decision.
4. Risk disclosure
Trading financial instruments and crypto-assets involves a high risk of loss. Prices are volatile and you may lose part or all of your capital. Past performance, backtests and historical patterns do not guarantee future results.
Where we publish accuracy statistics, they describe how often a condition was correctly identified in the past, measured against a comparison with random timing. They are not a forecast, they do not describe profit, and the underlying behaviour of markets can change at any time.
You are solely responsible for your trading decisions and their outcomes. Never invest more than you can afford to lose.
5. Accounts
You must provide accurate information and keep your credentials secure. You are responsible for all activity under your account. You must be at least 18 years old and legally able to enter into contracts. We may suspend or close accounts used in breach of these Terms.
6. Licences and permitted use
Desktop products are supplied under a personal, non-exclusive, non-transferable licence key, valid for the number of devices stated on the product page (hardware-locked) and for as long as the associated subscription remains active. Web tools are supplied as a subscription tied to your account.
You may not:
- share, resell, sublicense, publish or distribute licence keys or software;
- copy, decompile, reverse-engineer or modify the software, except where such restriction is prohibited by mandatory law;
- circumvent licence checks, usage limits or authentication;
- use the Services unlawfully, or in a way that damages or overloads our systems.
We remain the owner of all intellectual property in the software, content, trademarks and documentation. Nothing here transfers ownership to you.
7. Pricing, payment, renewal and cancellation
Prices are shown on the product pages and include applicable taxes where required. Payments are processed by Stripe; we do not store your card details.
- Subscriptions: renew automatically at the stated interval and price until cancelled. Renewal extends your existing licence key - your key does not change.
- Cancellation: you may cancel at any time, effective at the end of the current paid period. You keep access until that date. We do not charge cancellation fees.
- Manual renewal: where offered, it extends the same licence for one further period at the price shown, and does not renew automatically.
- Price changes: we may change prices for future periods and will give reasonable notice before the change applies to you.
Failure of a renewal payment may result in the licence expiring and the software ceasing to deliver alerts.
8. Right of withdrawal and refunds (EU consumers)
Our products are digital content and digital services supplied immediately after purchase.
Under EU consumer law you normally have 14 days to withdraw from a distance contract. However, by purchasing and requesting immediate access, you expressly consent to immediate supply of the digital content and acknowledge that you therefore lose your right of withdrawal once supply has begun (Art. 16(m) Directive 2011/83/EU). This consent is collected at checkout.
Consequently, purchases are generally non-refundable once the licence key has been issued or access has been granted.
This does not affect your statutory rights where the digital content is faulty, not as described, or does not conform to the contract. If a product does not work as described, contact us at bot-marketplace@bot-marketplace.com and we will repair, replace or, where appropriate, refund it as required by law.
9. Availability, changes and beta features
We aim for continuous availability but do not guarantee uninterrupted or error-free operation. Services may be affected by maintenance, third-party outages (exchanges, data providers, hosting) or factors outside our control.
Some features are marked beta and are provided "as is", with limited scope and possible interruptions. We may add, modify, or discontinue features; if we permanently discontinue a paid feature you have already paid for, we will provide a pro-rata refund for the unused period.
Third-party market data and on-chain data are provided by external sources; we do not guarantee their accuracy, completeness or timeliness.
10. Notifications
Alerts may be delivered by desktop notification, email or Telegram. Delivery depends on your device, network and third-party platforms, and cannot be guaranteed to be instantaneous or complete. Do not rely on any single alert channel for time-critical decisions.
11. Limitation of liability
To the fullest extent permitted by law, we are not liable for trading losses, missed opportunities, lost profits, or indirect or consequential damages arising from the use of, or inability to use, the Services - including delayed, missing or inaccurate alerts.
Our total aggregate liability for any claim is limited to the amount you paid us for the product concerned in the 12 months preceding the event giving rise to the claim.
Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, for fraud, or for any liability that cannot be excluded under mandatory law, including consumers' statutory rights.
12. Suspension and termination
We may suspend or terminate your access if you materially breach these Terms, in particular for sharing or tampering with licence keys, or for unlawful use. Where proportionate and possible, we will notify you first. You may stop using the Services at any time.
13. Privacy
We process personal data as described in our Privacy Policy. Desktop applications process market data locally on your device; a hardware identifier is used solely to enforce device limits on licences.
14. Changes to these Terms
We may update these Terms. The "Last updated" date shows the current version. For material changes affecting active subscriptions, we will give reasonable notice. Continued use after the change takes effect means you accept the updated Terms.
15. Governing law and disputes
These Terms are governed by Italian law. If you are a consumer resident in the EU, you keep the protection of the mandatory provisions of the law of your country of residence, and you may bring proceedings in your local courts.
